Benthon Tisell traveling safely in their car at Pildammsvägen in central Malmo January 2 this year when a portable toilet suddenly came flying.
– All of a sudden bang was heard from the driver’s side of the car. It just bang. I had eyes on the road so I did not see marshmallows come at all, he says.
The portable toilet had been parked at the curb and blown out on the road in the strong wind. The car had body damage and also received side window and mirror replaced.
Request SEK 3 000 in compensation
Benthon Tisell, which is normally a member of the technical committee in Malmo, now runs a damages case against Board one management – Highways Department.
He has asked SEK 3 000 in compensation for the excess.
– I think I should get back the excess. I was completely innocent of this, he says.
Empty portable loos
But Malmo city refuses to pay compensation, writes Skanska Dagbladet. The municipality believes that the accident was not caused by negligence, which is required for compensation to be given.
Benthon Tisell is critical.
– I would say that it did not come as a surprise that it was blowing that day. Marshmallows were probably emptied because it would not just fly away and should in such cases have been rooted in something. I call that negligence.
