Gotland County Administrative Board has proposed that the existing EU protected Natura 2000 area enlargement. It would then cover the forest where the company Nordkalk to open the controversial limestone quarry.
In a few weeks, the Land and Environmental Court hold a hearing in the hot issue. But Natura 2000 application should stop the whole legal process, considers the lawyer Johan Öberg representing two landowners.
– Everything has changed with this designation. We have a completely new situation which the court must take into account, he says to SVT.
He gets support from one of the country’s leading environmental lawyers, who argue that EU rules prevent it from going ahead with the permit issue .
– I can not see that the court can authorize this business now. It can make a judgment and refuse or suspend the matter until it is clear of the area comes up on the Natura 2000 list, says Professor Jonas Ebbesson at Stockholm University to SVT.
Environment Åsa Romson (MP) has previously said that Ojnareskogen should be protected. But now she wants to wait for the Environmental Protection Agency’s proposal for an extension of the Natura 2000 area.
