The flight was never – but the agency demanded payment anyway. Now, the customer, a woman in Falkirk, got right in the Supreme Court.
A couple of years ago, the woman, along with her living apart and some of his relatives, traveling to a wedding in Croatia. The day after the reservation, she was told that the airline went bankrupt. But the travel agency One ticket away (OTA) still wanted to have more than 20 000, since they had already sent the money to the airline.
The woman refused and was haled before the court. OTA claimed that they were just middlemen and that they had done what they committed themselves, namely to book and pay for tickets. The customer got right in court but lost in the Court of Appeal, who agreed that the agent only mediated the deal.
The Consumer Ombudsman considered the case of fundamental importance and ran it to the Supreme Court. HD rejects now the agent’s requirements. The tickets were bought on credit, and because the customer never got any trip she need not legally pay.
