the Swedish migration board has granted the family a permanentuppehållstillstånd on extremely compassionate grounds.
The decision to appeal now Yaras mother, Madleen Alnajjar.
Want to have protection
She wants that she and Yaras three siblings to be granted a permanent residence permit with a refugee status declaration, or protection status declaration.
the Reason is that she and the kids then can get the protection that they otherwise can not get. Without refugee status with a high level of protection is the mother afraid that she and the children are forced to return to Gaza of the family.
When the Yaras mother testified in november 2014 during the Yararrättegången she told me about the murder of her daughter affected relatives in the Gaza strip.
As a criminal
Madleen Alnajjar told me that she treated like a criminal. Her husband’s family mean that she is also is guilty of murder because she placed the Yara of its close relatives in Karlskrona.
When her lawyer, Karin Åkesson-Rehnholm asked her during the trial about what would happen if the family returned to Gaza, she replied:
– They would push my husband to separate from me and so they would take the children. The family controls more than the individual and they believe they have a revenge to take out.
Distressing circumstances
In connection with the trial, searched the family Alnajjar permanent residence as refugees with protection status declaration.
But the migration board does not believe that the family Alnajaar have refugee status, but granted the family on the grounds of particularly distressing circumstances.
the Mother has now appealed the decision to the Administrative court in Malmö, sweden. She wants the court to categorize her and the three children as refugees according to the geneva convention.
No appeal
Yaras father has not appealed since there is no släkthämnd against him.
the Court expects that the case will settle within two months.
