Domestic The woman was raped by two men when she followed in their car after a tavern visit. But the rapes took place “in turn” and was thus no gang rape, considered the Court of Appeal which changed the rubric of aggravated rape to rape – and lowered the penalty.
Now appeals the Prosecutor (RA) to the Supreme Court and urges that it is determined whether a gang rape to be considered as aggravated rape when more than one person has abused the victim.
– We believe, like the District court, that if you look at what the laws are charged should this be considered a rape, said prosecutor General Anders Perklev said.
– it is important that we get answers to whether there should be any other way.
the people involved met in Gothenburg in March 2015 and the rapes took place then at a rest stop north of Varberg. One of the men are still unidentified. The other, a 30 year old man, was sentenced first to four and a half years imprisonment and 180 000 in damages. Since the sentence was reduced to three and a half years in prison and damages ended up at 150 000th
