GP used Ekeroths images – are on trial – Expressen

On Thursday, stands the newspaper Göteborgs-Posten on trial in Gothenburg District Court.

It is MP Kent Ekeroth (SD) sued the newspaper for having used six pictures that showed the so-called “iron pipe scandal” and is now requesting 20,800 in damages.

– Our position is that there were strong reasons for the publication says Göteborgs-Posten editorial director Anders Goliger.

At nine o’clock on Thursday began hearing Hall 7 of the Gothenburg District Court. On hand was Kent Ekeroth yourself and Göteborgs-Posten editorial director Anders Goliger, which represents the newspaper.

Iron Pipe scandal was uncovered by Express in November 2012 as could see a movie Kent Ekeroth had filmed with his cellphone camera when he and Sweden Democrats Erik Almqvist and Christian Westling went to a verbal attack against the comedian and commentator Soran Ismail on a summer evening in Stockholm in 2010. The film also showed how the recent armed themselves with iron rods.

Even Göteborgs-Posten published photos from the movie in the newspaper and on gp.se. During the images had been stated as the source: “Movie Photos: PRIVATE, edited by Express”. The newspaper did not indicate that the images came from Kent Ekeroths movie.

Overall, the magazine has published six still images without permission. According Ekeroths lawsuit, the newspaper has not removed the images after he demanded it.

SD MP has sued Göteborgs-Posten for the unauthorized reproduction, unauthorized making available and violation of moral rights and claims for damages. Kent Ekeroth requires SEK 1 300 for unauthorized use on the Internet, 7500 crowns for newspaper publication, 6000 crowns for the omission of names and 6000 dollars for copyright infringement.



Making Money

Ekeroth has engaged Staffab Teste from the company image Ombudsman AB as agents to drive the process. Together they run processes against several other newspapers also published pictures from iron pipe film.

– Göteborgs-Posten has used pictures to make money, says Staffan Teste at Thursday’s hearing. Kent Ekeroth has suffered greatly for publication.

Göteborgs-Posten is willing to pay 775 SEK per image.

– Our attitude is that there were strong grounds for publication, says GP : editorial director Anders Goliger. It is in the public interest and Ekroths defense admits that without GP’s publication had not been given the same weight. For us it is a matter of principle. Remember that this lawsuit is about MPs who arm themselves with iron rods.

GP denies that Ekeroth copyright of the movie because they do not know who filmed.

– There is no information that it is a copyright infringement, says Christina Berggren, legal representative of the Stampen. Ekeroths requirements have to stand back for the right to freedom of expression. GP had not published the image the public had not been informed of political representatives. It appears in the GP’s items to Kent Ekeroth is the author in a way that is consistent with good journalistic practice.

Kent Ekeroth why he filed a lawsuit:

– The This case is it about that I have a right to my rights as a consumer, he says. It was just me who was filming and I have not given consent to the publication of the film.
