Strömstads badanstalt may continue with its own gym and spaverksamhet. It is contrary indeed to the Municipal Act, but not the Competition Act, strikes Market Court in guiding them.
Since 2012, the Competition Authority has pursued a lawsuit against Stromstad municipality regarding bathe Stole’s fitness and spaverksamhet. According authority operated business in direct competition with private companies.
The Market offers double vengeance. The Court may not municipalities pursue fitness and spa facilities as extensively as in Stromstad, but right Strömstads badanstalts competition is not strong enough for the business to be banned, it is considered.
