Skeleton Woman Christmas in the Court of Appeal – Göteborgs-Posten

Helena – who are called skeletal woman – were acquitted by the court. But the prosecutor does not give up and now a Christmas assessed by the court of appeal.

As an aftermath to the medial highly acclaimed destination where Helena was acquitted of charges of crimes against griftefriden she sent in December 2013 a Christmas card to the prosecutor Kristina Ehrenborg Staffas that pushed the case.

the card was sent to 28 people; law officers, officials of the social and Helena’s friends.

The Christmas card shows Helena with Santa hat in his couch, surrounded by skulls that are also dressed in Santa hats.

Helena explained that the card was a joke .

Prosecutor Ehrenborg Staffas did not see the fun, and a police report was made.

Helena was charged with three crimes: threats to the official, the official förgripelse and molestation. She was acquitted on all counts in a ruling in September.

The District Court noted that the text on the Christmas card was not in any way threatening. The Court considered that “normally” get a Christmas card with skulls to a prosecutor considered as a death threat. But this was the background special because Helena was charged just for possession of skulls.

Nor does the fact that Helena on his blog has been very critical of the prosecutor’s performance supports that she had any malicious intent. The District Court emphasizes that it is not an offense to criticize a prosecutor as long as they do not threaten.

Unwanted petitions could be molestation, but not a single Christmas card, consider the district court.

Prosecutor Klas Lundgren, Halmstad, which drove the goal of his dresses colleague, appealed on the grounds that he likes “just the opposite” the district court: Christmas is a threat precisely because Helena’s goal was about skeletons.

Lawyer Annika Stanislaus defends Helena and considers that the district court made a correct assessment. In a statement to the court of appeal, she writes that “the prosecutor seems to argue that it is not permissible to criticize a prosecutor handling and the information that the prosecutor leave to the media despite the fact that information is incorrect.”

Stanislaus indicate that the Prosecutor General and the Chancellor of Justice criticized the Ehrenborg Staffas commented and questioned his objectivity.

Christmas case will be brought in the Court of Appeal on March 31.
